Usually notice against entering or remaining can either be delivered in oral or written fashion by the property owner or an authorized agent. Laws vary slightly from state to state with some being very basic and others having very detailed requirements for providing proper notice.<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-205 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-206 bde-text\">\nTrespassing Consequences \u2013 Misdemeanor or Felony?\n<\/p><div class=\"bde-rich-text-10995-207 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>In most states criminal trespassing is punishable by a misdemeanor though in some it is considered a felony. Almost without fail the distinction is based on the situation and intent of the trespasser. Along with being charged with a misdemeanor or felony, trespassing usually comes with some kind of fine and\/or imprisonment. This authorization can be given by the land owner or an authorized representative. breakdance-rich-text-styles\">\n<p dir=\"ltr\">Alaska state laws for no trespassing are laid out in Alaska Statute Title 11 Chapter 46 Section 350, or\u00a0<a href=\"http:\/\/www.touchngo.com\/lglcntr\/akstats\/Statutes\/Title11\/Chapter46\/Section350.htm\">AS 11.46.350<\/a>.<\/p><p dir=\"ltr\">In layman\u2019s terms the statute states that assuming the person that has entered and\/or remains on land that is neither fenced nor designed to exclude intruders and has no intent to commit a crime can remain on the land unless the following is in place:<\/p><ul><li dir=\"ltr\"><p dir=\"ltr\">Notice is given to the person by the owner or by an authorized person that there is no trespassing.<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">Notice is given to the person in a\u00a0<strong>reasonably visible way<\/strong>\u00a0based on the circumstances.<\/p><\/li><\/ul><p dir=\"ltr\">This notice is sufficient if it\u00a0<strong>meets the following requirements<\/strong>:<\/p><ul><li dir=\"ltr\"><p dir=\"ltr\">Legible in English<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">It is at least 144 square inches in size<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">Contains name and address of both the person whose authority is posting the sign and the one that can grant permission to enter<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">Is placed at all known access points to the property<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">If an island, posted at each cardinal point of the island<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">States specific prohibitions such as no digging, hunting, fishing, trespassing, etc.<\/p><\/li><\/ul>\n<\/div>\n<\/div><div class=\"bde-div-10995-225 bde-div\">\n  \n  \n\t\n\n\n\n<a by a land owner, an authorized representative or law enforcement. It is also c<strong>onsidered trespassing if \u201creasonable notice prohibiting entry\u201d has been posted<\/strong>. The law states that any person who enters onto private property that is enclosed or cultivated without written permission from the owner or authorized agent is guilty of trespassing. Further, uncultivated and unenclosed land\u00a0<strong>with signs forbidding trespass \u201cat intervals not less than three to the mile along all exterior roads and trails entering the land\u201d<\/strong>\u00a0is also considered trespassing. Trespassing occurs when someone \u201cknowingly and unlawfully enters or remains\u201d in or on a property in which they don\u2019t have authorization or license to do so. To point, any person who enters and remains unlawfully without consent from the land owner or an authorized person, or enters on a fenced or enclosed area can be found guilty of trespassing.\u00a0<strong>The difference is that there is not verbiage around unenclosed areas and signage that would still cause trespassers to be charged. They are detailed in sections\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0800-0899\/0810\/Sections\/0810.011.html\">810.011 (definitions)<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0800-0899\/0810\/0810.html\">810.08 \u2013 810.12<\/a>\u00a0in particular. \u00a0Florida defines in great detail different structures and circumstances in which trespassing would be applicable. Notwithstanding, it occurs primarily when someone enters and remains without being authorized to do so. It is also unlawful to damage or remove no trespassing signage.<\/p><p dir=\"ltr\">The signage itself deems the land \u201cposted land\u201d and must meet the following stipulations:<\/p><p dir=\"ltr\">\u201c(5)(a) \u201cPosted land\u201d is that land upon which:<\/p><p dir=\"ltr\">1. Signs are placed\u00a0<strong>not more than 500 feet apart along, and at each corner of, the boundaries of the land<\/strong>, upon which signs there appears prominently, in\u00a0<strong>letters of not less than 2 inches in height, the words \u201cno trespassing\u201d<\/strong>\u00a0and in addition thereto the\u00a0<strong>name of the owner, lessee, or occupant of said land<\/strong>. Said signs shall be placed along the boundary line of posted land in a manner and in such position as to be clearly noticeable from outside the boundary line; or<\/p><p dir=\"ltr\">2.a.\u00a0<strong>Conspicuous no trespassing notice is painted on trees or posts<\/strong>\u00a0on the property, provided that the notice is:<\/p><p dir=\"ltr\">(I) Painted in an\u00a0<strong>international orange color and displaying the stenciled words \u201cNo Trespassing\u201d in letters no less than 2 inches high and 1 inch wide either vertically or horizontally<\/strong>;<\/p><p dir=\"ltr\">(II) Placed so that the bottom of the painted notice is\u00a0<strong>not less than 3 feet from the ground or more than 5 feet from the ground<\/strong>; and<\/p><p dir=\"ltr\">(III) Placed at locations that are\u00a0<strong>readily visible to any person approaching the property and no more than 500 feet apart on agricultural land<\/strong>.<\/p><p dir=\"ltr\">b. They are detailed in the\u00a0<a href=\"http:\/\/statutes.laws.com\/georgia\/title-16\/chapter-7\/article-2\/part-1\/16-7-21\">Georgia Statutes and Codes \u00a7 16-7-21 \u2013 Criminal trespass<\/a>. Trespassing is when someone knowingly enters and remains on private property without the proper authorization of the owner or an agent.\u00a0<strong>There is no specific verbiage around posted signage other than violators must have received \u201cnotice from the owner\u2019 prior to entry \u2013 which if interpreted presumably could mean verbal warning or posted signage. This is applicable to commercial properties and must be issued within a one year period in which the event took place. It may or may not contain other details as outlined at the link above.<\/p><p dir=\"ltr\">For\u00a0<strong>agricultural lands that are neither enclose nor designed to keep intruders out, signage must be visibly displayed and clearly noticeable from outside the property and include<\/strong>:<\/p><ul><li dir=\"ltr\"><p dir=\"ltr\">the words \u201cPrivate Property\u201d<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">letters not less than 2 inches in height<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">placed along the border of and roads\/trails entering into the property<\/p><\/li><\/ul><p dir=\"ltr\">Lastly,\u00a0<strong>unused or unimproved lands needs to have clearly visible signage with some kind of verbiage of \u201cPrivate Property \u2013 No Trespassing\u201d or \u201cGovernment Property \u2013 No Trespassing\u201d. These state that \u00a0a variety of acts upon real property after knowingly entering where one does not have authorization constitute trespassing. In this case, signage\u00a0<strong>must meet the following description<\/strong>:<\/p><p>\u201cPosted with \u201cNo Trespassing\u201d signs, is posted with a minimum of one hundred (100) square inches of fluorescent orange, bright orange, blaze orange, safety orange or any similar high visibility shade of orange colored paint except that when metal fence posts are used, a minimum of eighteen (18) inches of the top of the post must be painted a high visibility shade of orange, or other notices of like meaning, spaced at intervals of not less than one (1) sign, paint area or notice per six hundred sixty (660) feet along such real property; provided that where the geographical configuration of the real property is such that entry can reasonably be made only at certain points of access, such property is posted sufficiently for all purposes of this section if said signs, paint or notices are posted at such points of access;\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div><div class=\"bde-div-10995-314 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-315 bde-text\">\nIllinois\n<\/p><div class=\"bde-rich-text-10995-316 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>According to\u00a0<a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs4.asp?DocName=072000050HArt.+24&amp;ActID=1876&amp;ChapterID=53&amp;SeqStart=62900000&amp;SeqEnd=65800000\">Illinois Criminal Code 720 ILCS 5\/21-3<\/a>\u00a0trespassing in Illinois occurs when someone knowingly enters without consent or authorization from the owner or an agent. The owner or occupant, amongst other things,\u00a0<strong>must ensure that written notice forbidding entry is posted in a visible way at the main entrance to the land or property or forbidden part. Other markings can include use \u201cpurple marks\u201d on poles or trees to prevent trespassing. This is only applicable to municipalities of under 2,000,000 inhabitants<\/strong>. Persons entering and\/or remaining without proper consent will be found to have trespassed. Minnesota laws are some of the most detailed in the nation and outline many different definitions for sites and actions related to trespassing. The law also outlines a number of requirements for what they call \u201cposted\u201d notice for different settings.\u00a0<strong>Namely, that signage for a locked building must be:<\/strong><\/p><ul><li dir=\"ltr\"><p dir=\"ltr\">8.5\u201d x 11\u201d in size<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">be placed in a conspicuous place on the exterior of the building, or a visible spot on the property in which the building sits<\/p><\/li><li dir=\"ltr\"><p dir=\"ltr\">must carry a general notice warning against trespass<\/p><\/li><\/ul><p dir=\"ltr\">Further,\u00a0<strong>for construction areas<\/strong>\u00a0of greater size the number of signs that is required goes up for each full 10 acres of land. The sign must be 8.5\u201d x 11\u201d in size and be place in a conspicuous manner. \u00a0Signage for a\u00a0<strong>mining location<\/strong>\u00a0must meet similar requirements including:<\/p><p dir=\"ltr\">\u201c(A) carry a general notice warning against trespass;<\/p><p dir=\"ltr\">\u00a0\u00a0(B) display letters at least two inches high;<\/p><p dir=\"ltr\">\u00a0\u00a0(C) state that Minnesota law prohibits trespassing on the property; and<\/p><p dir=\"ltr\">\u00a0\u00a0(D) are posted in a conspicuous place and at intervals of 500 feet or less.\u201d<\/p><p dir=\"ltr\">With some of the most detailed laws, land and property owners would be wise to read these guidelines carefully straight from the source as linked to above. Upon entering and remaining without proper authorization a person is found guilty of\u00a0<a href=\"http:\/\/www.moga.mo.gov\/statutes\/C500-599\/5690000140.HTM\">first degree trespass<\/a>. This is considered a Class B misdemeanor. This occurs only when the property is fenced or enclosed in a way to exclude intruders, it is communicated verbally or\u00a0<strong>posted in a manner which is reasonably likely to be seen. So like many some other states a simple no trespassing sign of good size and a clear message will suffice.<\/strong>\u00a0Similar to Illinois, purple paint to mark streets and posts can also be used and is detailed\u00a0<a href=\"http:\/\/www.moga.mo.gov\/statutes\/C500-599\/5690000145.HTM\">here<\/a>.<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-465 bde-div\">\n  \n  \n\t\n\n\n\n<div class=\"bde-div-10995-469 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-470 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=2043e235-3955-45ca-9572-fbf098a32c8c\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-737 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing2-300x66.jpg\" alt=\"no trespassing yellow generic\" loading=\"lazy\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-466 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-467 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=f89eeaf5-a298-4ac2-84c7-8ee5b147525b\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-738 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassingViolatorsWBP-300x136.jpg\" alt=\"violators will be prosecuted black and white\" loading=\"lazy\">\n\n<\/a>\n<\/div>\n<\/div><div class=\"bde-div-10995-472 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-473 bde-text\">\nMontana\n<\/p><div class=\"bde-rich-text-10995-474 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">Criminal trespassing laws for Montana are outlined in\u00a0<a href=\"http:\/\/codes.lp.findlaw.com\/mtcode\/45\/6\/2\/45-6-201\">Montana Code Section 45-6-201<\/a>. \u00a0Entering and remaining without the license or privilege to do so constitutes trespassing in Montana.\u00a0<strong>Though privilege to do so in Montana\u2019s case can be the simple failure of the landowner to \u201cpost notice denying entry onto private land.\u201d<\/strong><\/p><p dir=\"ltr\">This\u00a0<strong>signage must meet the following requirements:<\/strong><\/p><p dir=\"ltr\">\u201c(a) notice must be placed on a post, structure, or natural object by marking it with written notice or with not less than 50 square inches of fluorescent orange paint, except that when metal fence posts are used, the entire post must be painted; and<\/p><p dir=\"ltr\">(b) the notice described in subsection (2)(a) must be placed at each outer gate and normal point of access to the property, including both sides of a water body crossing the property wherever the water body intersects an outer boundary line.<\/p><p dir=\"ltr\">(3) To provide for effective posting of private land through which or along which the public has an unfenced right-of-way by means of a public road, a landowner shall:<\/p><p dir=\"ltr\">(a) place a conspicuous sign no closer than 30 feet of the centerline of the roadway where it enters the private land, stating words substantially similar to \u201cPRIVATE PROPERTY, NO TRESPASSING OFF ROAD NEXT ___ MILES\u201d; There are different degrees of criminal trespass in Nebraska as outlined in the sections noted above.\u00a0<strong>Signage, \u201cwhen posted in a manner prescribed by law or reasonably likely to come to the attention of intruders\u201d elevates the crime to second degree.<\/strong>\u00a0<strong>Thus, visible signage denoting \u201cNo Trespassing\u201d ensures that intruders will be subject to tougher penalties<\/strong>.<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-485 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-488 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=27927ef6-c55f-4ffc-891c-611f02b60e08\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-740 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing1-300x85.jpg\" alt=\"no trespassing red generic\" loading=\"lazy\">\n\n<\/a><a class=\"bde-container-link-10995-486 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=2043e235-3955-45ca-9572-fbf098a32c8c\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-741 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing2-300x66.jpg\" alt=\"no trespassing yellow generic\" loading=\"lazy\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-490 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-491 bde-text\">\nNevada\n<\/p><div class=\"bde-rich-text-10995-492 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">Criminal trespassing laws in Nevada are part of Chapter 207 of Nevada\u2019s Revised Statutes.\u00a0<a href=\"http:\/\/leg.state.nv.us\/NRS\/NRS-207.html#NRS207Sec200\">NRS 207.200<\/a>\u00a0states that anyone who willfully goes upon or remains on land where they not authorized to be is guilty of trespassing and will be charged with a misdemeanor. This occurs after having been warned,\u00a0<strong>which means some kind of generic no trespassing signage needs to be present.<\/strong><\/p><p dir=\"ltr\">Further,\u00a0<strong>more stringent signage regulations are outlined for land with agricultural purposes.<\/strong>\u00a0These are:<\/p><p dir=\"ltr\">\u201cby painting with fluorescent orange paint:<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (1) Not less than 50 square inches of the exterior portion of a structure or natural object or the top 12 inches of the exterior portion of a post, whether made of wood, metal or other material, at:<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (I) Intervals of such a distance as is necessary to ensure that at least one such structure, natural object or post would be within the direct line of sight of a person standing next to another such structure, natural object or post, but at intervals of not more than 1,000 feet; and<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (II) Each corner of the land, upon or near the boundary; and<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (2) Each side of all gates, cattle guards and openings that are designed to allow human ingress to the area;<\/p><p dir=\"ltr\">\u00a0 (b) If the land is not used in the manner specified in paragraph (a), by painting with fluorescent orange paint not less than 50 square inches of the exterior portion of a structure or natural object or the top 12 inches of the exterior portion of a post, whether made of wood, metal or other material, at:<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (1) Intervals of such a distance as is necessary to ensure that at least one such structure, natural object or post would be within the direct line of sight of a person standing next to another such structure, natural object or post, but at intervals of not more than 200 feet; and<\/p><p dir=\"ltr\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (2) Each corner of the land, upon or near the boundary;\u201d<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-493 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-496 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=2043e235-3955-45ca-9572-fbf098a32c8c\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-742 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing2-300x66.jpg\" alt=\"no trespassing yellow generic\" loading=\"lazy\">\n\n<\/a><a class=\"bde-container-link-10995-494 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=27927ef6-c55f-4ffc-891c-611f02b60e08\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-743 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing1-300x85.jpg\" alt=\"no trespassing red generic\" loading=\"lazy\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-498 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-499 bde-text\">\nNew Hampshire\n<\/p><div class=\"bde-rich-text-10995-500 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">Laws for trespassing in New Hampshire are outlined in New Hampshire\u2019s Revised Statutes. The person is guilty of trespassing when they knowingly enter or remain in any place they are not authorized to be in. Any trespassing in a \u201csecured premises\u201d warrants a misdemeanor. Criminal trespassing merits a misdemeanor and can also mean the loss of a hunting or fishing license. Removing no trespassing signage also results in a misdemeanor.<\/p><p dir=\"ltr\">Specific signage laws in regards to no trespassing are outlined in 30-14-6. Real property requires that\u00a0<strong>notice be placed along the exterior boundaries of the property or other access points in a visible manner. These are found in \u00a7 14-159.7.<\/p><p dir=\"ltr\">\u201cFor purposes of posting property under G.S. 14-159.7, the owner or lessee of the property may use either of the following methods:<\/p><p dir=\"ltr\">(1) \u00a0\u00a0\u00a0 The owner or lessee of the property may place notices, signs, or posters on the property. The notices, signs or posters shall measure not less than 120 square inches and shall be conspicuously posted on private lands not more than 200 yards apart close to and along the boundaries. At least one such notice, sign, or poster shall be posted on each side of such land, and one at each corner thereof, provided that said corner can be reasonably ascertained. For the purpose of prohibiting fishing, or the taking of fish by any means, in any stream, lake, or pond, it shall only be necessary that the signs, notices, or posters be posted along the stream or shoreline of a pond or lake at intervals of not more than 200 yards apart.<\/p><p dir=\"ltr\">(2) \u00a0\u00a0\u00a0 The owner or lessee of the property may place identifying purple paint marks on trees or posts around the area to be posted. Each paint mark shall be a vertical line of at least eight inches in length, and the bottom of the mark shall be no less than three feet nor more than five feet from the base of the tree or post. The paint marks shall be placed no more than 100 yards apart and shall be readily visible to any person approaching the property. Trespassers are those who willfully trespass and remain on the land with no purpose to do so and lacking permission. This must occur after having been forbidden to do so by those authorized. In essence they are the same as many of the other states in that a person entering and remaining when having no permission to do so will be guilty of trespassing. Offenders will be subject to varying levels of crimes, fines and potential imprisonment.<\/p><p dir=\"ltr\"><strong>As for signage, agricultural lands require posting of notice in conspicuous places on the four borders of the land. Criminal trespass is defined as a person entering or remaining on or in property without \u201ceffective consent.\u201d To be considered trespassing there must be verbal or written notice.\u00a0<strong>If unfenced, written notice can be done in two ways. When proper notice is given, trespassers who enter or remain on any land or place shall be subject to up to 3 months in prison and a fine of $500, or both. The law states that any person without authority who enters or remains on property or premises will be guilty of criminal trespassing. Consent can be given orally or in written fashion.\u00a0<strong>Signage forbidding such entry should be placed on the \u201cpremises or portion or area thereof at a place or places where it or they may be reasonably seen.\u201d<\/strong>\u00a0Guilty parties will be charged with a Class 1 misdemeanor. Trespassers may be guilty in several different situations including hunting, fishing or trapping. In particular, property owners using\u00a0<strong>signage for these situations need to place:<\/strong><\/p><p dir=\"ltr\"><strong>\u201csigns prohibiting hunting, fishing or trapping where they may reasonably be seen; or (ii) placing identifying paint marks on trees or posts at each road entrance and adjacent to public roadways and public waterways adjoining the property.<\/strong>\u00a0Each paint mark shall be a vertical line of at least two inches in width and at least eight inches in length and the center of the mark shall be no less than three feet nor more than six feet from the ground or normal water surface. Such paint marks shall be readily visible to any person approaching the property.<\/p><p dir=\"ltr\">B. The type and color of the paint to be used for posting shall be prescribed by the Department of Game and Inland Fisheries.\u201d<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-682 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-683 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=27927ef6-c55f-4ffc-891c-611f02b60e08\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-774 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing1-300x85.jpg\" alt=\"no trespassing red generic\" loading=\"lazy\">\n\n<\/a><a class=\"bde-container-link-10995-685 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=2d143222-ed5b-4dd1-81ec-aae5c0996b1a\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-775 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/RestrictedAccess-300x214.jpg\" alt=\"restricted access white on red\" loading=\"lazy\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-599 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-600 bde-text\">\nWashington\n<\/p><div class=\"bde-rich-text-10995-601 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">The Washington Criminal Code contains Washington trespassing laws. Details can be found in\u00a0<a href=\"http:\/\/apps.leg.wa.gov\/RCW\/default.aspx?cite=9A.52\">Title 9A.52<\/a>. In Washington, to enter and remain unlawfully without privilege or license constitutes trespassing. Trespassing in such a manner is considered a misdemeanor.\u00a0<strong>Signage plays a key role particularly in situations where land is unused or otherwise not enclosed as notice can be given by being posted in a conspicuous manner. In other words some kind of basic no trespassing sign posted in an obvious and visible manner will be sufficient to give the property owner legal recourse.<\/strong><\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-687 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-690 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=2043e235-3955-45ca-9572-fbf098a32c8c\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-776 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/NoTrespassing2-300x66.jpg\" alt=\"no trespassing yellow generic\" loading=\"lazy\">\n\n<\/a><a class=\"bde-container-link-10995-688 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=bd572521-6443-49b1-a6ce-5ba40df04b94\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-777 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/DangerNoTrespassing1-300x231.jpg\" alt=\"danger no trespassing generic\" loading=\"lazy\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-602 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-603 bde-text\">\nWest Virginia\n<\/p><div class=\"bde-rich-text-10995-604 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">West Virginia\u2019s no trespassing laws are explained in\u00a0<a href=\"http:\/\/www.legis.state.wv.us\/wvcode\/Code.cfm?chap=61&amp;art=3B#03B\">Chapter 61 Article 61-3B<\/a>. \u00a0West Virginia\u2019s definition of criminal trespassing is, \u201cwillful unauthorized entry upon, in or under the property of another.\u201d In most instances this is punishable by a misdemeanor and a fine but in some cases this can be a felony.\u00a0<strong>Signage requirements for \u201cposted\u201d land are as follows:<\/strong><\/p><p dir=\"ltr\">\u201c\u2018Posted land\u2019 is that land upon which\u00a0<strong>reasonably maintained signs are placed not more than five hundred feet apart along and at each corner of the boundaries of the land<\/strong>, upon which signs there\u00a0<strong>appears prominently in letters of not less than two inches in height the words \u201cno trespassing\u201d and in addition thereto the name of the owner, lessee or occupant of the land.<\/strong>\u00a0The signs shall be placed\u00a0<strong>along the boundary line of posted land in a manner and in a position as to be clearly noticeable from outside of the boundary line.<\/strong>\u00a0It shall not be necessary to give notice by posting on any enclosed land or place not exceeding five acres in area on which there is a dwelling house or property that by its nature and use is obviously private in order to obtain the benefits of this article pertaining to trespass on enclosed lands.\u201d<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-692 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-693 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=fa4ef79a-5bf0-4675-bbc3-76414aadaff6\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-694 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/WestVirginia1-300x121.jpg\" alt=\"west virginia no trespassing red\" loading=\"lazy\" sizes=\"(max-width: 300px) 100vw, 300px\">\n\n<\/a><a class=\"bde-container-link-10995-695 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=dad63dde-18d9-41d9-a076-13743812e6e7\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-696 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/WestVirginia2-300x100.jpg\" alt=\"west virginia black\" loading=\"lazy\" sizes=\"(max-width: 300px) 100vw, 300px\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-605 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-606 bde-text\">\nWisconsin\n<\/p><div class=\"bde-rich-text-10995-607 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p dir=\"ltr\">Wisconsin no trespassing laws are found in the crimes against property section which is Chapter 943. \u00a0They are specifically found in\u00a0<a href=\"http:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/943\/II\/13\/1m\/b\">943.13 \u2013 943.15<\/a>. \u00a0To enter or remain on \u201cenclosed, cultivated or undeveloped land of another\u2026without the express or implied consent of the owner or occupant\u201d is how Wisconsin defines trespassing. In most cases this is considered some Class of a misdemeanor and may involve a forfeiture. Wisconsin gives\u00a0<strong>lots of details on signage in regards to trespassing or \u201cposted\u201d land<\/strong>.<\/p><p dir=\"ltr\">Notice can come through signs if it\u00a0<strong>meets the following<\/strong>:<\/p><p dir=\"ltr\">\u201c1. If a sign at least 11 inches square is placed in at least 2 conspicuous places for every 40 acres to be protected. The sign must provide an appropriate notice and the name of the person giving the notice followed by the word \u201cowner\u201d if the person giving the notice is the holder of legal title to the land and by the word \u201coccupant\u201d if the person giving the notice is not the holder of legal title but is a lawful occupant of the land. Proof that appropriate signs as provided in this subdivision were erected or in existence upon the premises to be protected prior to the event complained of shall be prima facie proof that the premises to be protected were posted as provided in this subdivision.<\/p><p dir=\"ltr\"><a href=\"http:\/\/docs.legis.wisconsin.gov\/document\/statutes\/943.13(2)(am)2.\">943.13(2)(am)<\/a><\/p><p dir=\"ltr\">2. If markings at least one foot long, including in a contrasting color the phrase \u201cprivate land\u201d and the name of the owner, are made in at least 2 conspicuous places for every 40 acres to be protected.\u201d<\/p><p dir=\"ltr\">Property owners must also use a sign that is at least 5\u201d x 7\u201d that is \u201clocated in a prominent place near all of the entrances to the part of the building to which the restriction applies or near all probable access points to the grounds to which the restriction applies and any individual entering the building or the grounds can be reasonably expected to see the sign in order to prevent firearms from being carried in various situations and settings.<\/p>\n<\/div>\n<\/div><div class=\"bde-div-10995-697 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-10995-698 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=b67d5000-01eb-4a8d-848e-6cdf7f3ea276\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-778 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/Wisconsin1-e1385421153968.jpg\" loading=\"lazy\" sizes=\"(max-width: 299px) 100vw, 299px\">\n\n<\/a><a class=\"bde-container-link-10995-700 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=370f50ab-2920-48b9-90da-61267ff551f4\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-10995-701 bde-image2\" src=\"https:\/\/qasigns-blog.signs.com\/blog\/wp-content\/uploads\/2013\/11\/Wisconsin2-e1385417863455.jpg\" alt=\"wisconsin do not enter sign\" loading=\"lazy\" sizes=\"(max-width: 418px) 100vw, 418px\">\n\n<\/a>\n<\/div><div class=\"bde-div-10995-608 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-10995-609 bde-text\">\nWyoming\n<\/p><div class=\"bde-rich-text-10995-610 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>No trespassing laws in Wyoming are found in the\u00a0<a href=\"http:\/\/legisweb.state.wy.us\/statutes\/statutes.aspx?file=titles\/Title6\/T6CH3.htm\">Wyoming Statutes in Title 6 Chapter 3 Article 303<\/a>. It states that a person is guilty of trespassing when they enter or remain on or in the land or premises of another person without authorization to do so, or after being notified of such. This is punishable by a misdemeanor and can carry imprisonment of not more than 6 months and a fine not exceeding $750, or both.
